PUBLIC NOTICE

NOTICE OF NEGOTIATED OFFER TO PURCHASE REAL PROPERTY

Under and by virtue of an Order of the Clerk of Superior Court of Hyde County, North Carolina, made and entered on the 11th day of August 2025 in the action entitled “Peggy T. Smith, Administrator of the Estate of Larry W. Gibbs, Petitioner v. Robert W. Gibbs et al., Respondents” (File No.: 23SP000011-470), a Negotiated Order To Purchase and Contract of the real property known as the former property of Larry W. Gibbs located at 1570 White Plains Road in Lake Landing Township, North Carolina (Parcel Number 6009) and more particularly described in Book 172, Page 769 of the Hyde County Registry, consisting of nine (9) acres more or less subject to all liens, deeds of trust, rights of way, easements, utility easements, and any other encumbrances of record, if any, in the Hyde County Registry was signed on January 13, 2026 by the Petitioner accepting the offer of Justin L. Tucker to purchase the same for $60,000.00 subject to confirmation by the Hyde County Clerk of Superior Court. The real property which Justin L. Tucker has offered to purchase from the Petitioner is described as follows:
All that certain lot or parcel of land situated in Lake Landing Township, Hyde County, North Carolina, and more particularly described as follows:
Beginning at a point in the Northwest edge of the public road that leads from Middletown to Nebraska by way of White Plains where the same is intersected by the northeastward edge of the right of way of Rattlesnake Canal; thence running from said beginning point North 47 degrees 45 minutes East, along the northwestward edge of the aforesaid public road, 828 feet to a curve in the edge of said road; thence running North 38 degrees 45 minutes East, continuing along the northwestward edge of said road, 268 feet to a point in the southward corner of that part of the B.B. Fulford tract of land now or formerly owned by Mrs. Ella Mae Gibbs; thence running North 40 degrees West, along the southwestward line of said Fulford tract, 422 feet to a point where said line is intersected by the Southeast line of the Ellen Burrus tract of land formerly owned by Guy Spencer; thence running South 47 degrees 10 minutes West, along the Southeast line of said Burrus tract, which is the center of a ditch, 1098 feet to a point in the eastward edge of the right of way of the Rattlesnake Canal; thence running South 41 degrees 15 minutes East, along the northeastward edge of the right of way of Rattlesnake Canal, 452 feet to the point of beginning, containing 11.41 acres, more or less. This is the same land described in a deed to James Emery Midyette Jr. and wife, from James E. Midyette and wife, dated February 22, 1995 and recorded in Hyde County in Book 153 at Page 52.
The property is being sold subject to, and the last and highest bidder shall be responsible for, all deed recording costs, excise stamps, current and delinquent ad valorem property taxes, special assessments, and all local improvement assessments, including but not limited to any tax including drainage district taxes, all of which must be paid at closing. If the bid is raised, the bidder shall deposit with the Hyde County Clerk of Superior Court five percent (5%) of the increased bid amount or $750.00, whichever is greater, in cash or certified funds. This procedure shall be repeated until no further qualifying bids are received. The Petitioner may accept the offer and sell the property to the highest bidder subject to the approval of the Hyde County Clerk of Superior
Court.
