PUBLIC NOTICE

TOWN OF BELHAVEN
NORTH GAROLINA
RESOLUTION OF INTENT TO PERMANENTLY CLOSE
A PORTION OF ELM STREET EXTENSION
AND SETTING A PUBLIC HEARING

WHEREAS, Section 160A-299 of the North Carolina General Statutes prescribes the procedure to be followed by a town in order to permanently close a street or alley;
WHEREAS, in order for a municipality to properly and lawfully permanently close a street, Section 160A- 299 of the North Carolina General Statutes requires that the Board of Aldermen of the Town of Belhaven first adopt a resolution declaring its intent to permanently close the street (or portion thereof) in question and then call a public hearing on the question;
WHEREAS, the Board of Aldermen has determined that it is advisable to consider permanently closing a portion of Elm Street Extension, specifically including, without limitation, the 300’ undeveloped portion at the northeastern most point of Elm Street Extension, as seen on the map attached as Exhibit A;
WHEREAS, the above-mentioned undeveloped portion of Elm Street Extension has never been constructed or opened by the Town;
WHEREAS, such action would result in this unimproved portion of Elm Street Extension being divided by any adjoining property owner; and
WHEREAS, such action would not deprive any property owner of a reasonable means of ingress or egress to his or her property by virtue of closing the street as described above.
NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the Town of Belhaven, North Carolina that this Board declares its intention to consider the permanent closure of the northeastern most portion of Elm Street Extension as described above, and
1. That a public hearing on this matter is called by the Board of Aldermen at the Belhaven Civic
Center on April 13, 2026 at 6:00 p.m.
2. The Office of the Town Clerk is directed to cause to a copy of this resolution to:
a. Be published in the Washington Daily News once a week for four successive weeks;
b. Sent to all owners of adjoining property by registered or certified mail; and
c. Be prominently posted in at least two places along Elm Street Extension.
